Terms and Conditions

1. Definitions

  • Platform: the website wikbriefversturen.nl, operated by Credifin Nederland B.V.
  • Service Provider: Credifin Nederland B.V., registered in Amsterdam, CoC 34226691.
  • User: any natural or legal person who creates an account and uses the Platform.
  • WIK letter: a fourteen-day notice (formal demand letter) in accordance with Article 6:96(6) of the Dutch Civil Code, generated via the Platform.
  • Credit: a digital unit entitling the User to send one WIK letter via the Platform.
  • Debtor: the person or organisation to whom the WIK letter is addressed.

2. Applicability

These Terms and Conditions apply to all use of the Platform and all agreements between the Service Provider and the User. By creating an account or using the Platform, the User agrees to these terms.

The Service Provider reserves the right to amend these terms. In the event of material changes, the User will be notified by e-mail. Continued use of the Platform after such changes constitutes acceptance of the amended terms.

3. The Service

The Platform enables the User to:

  • Have invoice data extracted from uploaded documents (PDF, image, or scan);
  • Generate a WIK letter (fourteen-day notice) based on this data in accordance with the Dutch Collection Costs Act;
  • Have collection costs automatically calculated according to the statutory scale;
  • Download the WIK letter as a PDF or send it by e-mail via the Platform;
  • Download a delivery confirmation as proof of dispatch.

The Platform is a tool for drafting and sending formal demand letters. The Platform does not provide legal advice and is not a law firm or debt collection agency. The User remains solely responsible for the accuracy of the data entered and for compliance with all applicable legal requirements.

4. Account and Registration

An account is required to use the Platform. Upon registration, the User must provide truthful and up-to-date business information. The User is responsible for keeping login credentials confidential and for all activity that occurs under their account.

The Service Provider reserves the right to refuse, suspend, or terminate accounts without stating reasons, particularly in cases of (suspected) misuse or fraud.

5. User Responsibility

The User is fully and solely responsible for:

  • The accuracy and completeness of all data entered, including but not limited to: invoice number, amounts, name and address of the debtor, and the debtor's e-mail address;
  • The correct entry of the debtor's e-mail address. If the User provides an incorrect e-mail address, the Service Provider bears no liability whatsoever;
  • The legitimacy of the claim. The User warrants that the invoice underlying the WIK letter is genuinely owed and that the payment due date has passed;
  • Compliance with all applicable laws and regulations when sending demand letters;
  • Maintaining proper records and supporting documentation for the claim.

6. Liability

6.1 Limitation of liability

The Service Provider is not liable for:

  • Damage arising from the entry of incorrect, incomplete, or outdated data by the User, including an incorrect debtor e-mail address;
  • The non-delivery or non-opening of e-mails by the receiving party, regardless of the cause (spam filters, full mailbox, incorrect address, technical failures at the receiving mail server);
  • Legal disputes between the User and the debtor arising from the sending of a WIK letter;
  • Direct or indirect damage, including lost profits, missed savings, reputational damage, or consequential damage of any kind arising from the use of the Platform;
  • The substantive accuracy of automatically extracted invoice data. The User must always verify the data before sending;
  • Disruptions, interruptions, or errors in the Platform, the e-mail service, or third-party servers;
  • Damage resulting from unauthorized access to the User's account due to insufficient protection of login credentials.

6.2 Maximum liability

If the Service Provider is held liable for any reason whatsoever, liability shall at all times be limited to the amount the User has paid to the Service Provider in the three (3) months preceding the event giving rise to the liability, with a maximum of EUR 100.

6.3 E-mail and delivery

The Platform uses an external e-mail service (Resend) for sending WIK letters by e-mail. The Service Provider endeavours to send e-mails correctly and provides a delivery confirmation as proof, but cannot guarantee that e-mails will actually be delivered or opened. The delivery confirmation serves as an indication only and does not constitute conclusive legal proof.

7. Fraud and Misuse

7.1 Prohibited use

It is expressly prohibited to use the Platform for:

  • Sending demand letters for fictitious, false, or unlawful claims;
  • Deliberately intimidating, threatening, or pressuring persons who owe nothing;
  • Misusing the Platform as a means for fraud, identity theft, or any other form of deception;
  • Sending demand letters to persons or businesses with whom no actual business relationship exists;
  • Entering details of another company as creditor without being authorised to do so;
  • Any other act that violates Dutch law, public morals, or public order.

7.2 Measures

In the event of (suspected) misuse or fraud, the Service Provider is entitled to:

  • Immediately suspend or terminate the User's account, without refund of credits or amounts paid;
  • File a report with the competent authorities;
  • Recover all damages from the User, including investigation costs and legal fees;
  • Retain and share User data with law enforcement authorities where a legal basis exists.

7.3 Indemnification

The User indemnifies the Service Provider fully against all claims by third parties arising from or related to the User's use of the Platform, including claims by debtors, regulators, or other parties. This includes all damages, costs (including legal fees), and fines incurred by the Service Provider as a result.

8. Pricing and Payment

Upon creating an account, the User receives a number of free credits. Additional credits can be purchased via the Platform. All prices include VAT, unless stated otherwise.

Payment is processed via the payment service Stripe. Upon successful payment, credits are immediately added to the User's account.

Credits once purchased are non-refundable, except where the Service Provider is legally required to do so. Credits are non-transferable and have no monetary value outside the Platform.

9. Intellectual Property

All rights to the Platform, the software, the design, texts, logos, and other materials are vested in the Service Provider. No part of the Platform may be reproduced, stored, or published without prior written permission.

The WIK letters generated by the Platform may be freely used by the User for the purpose for which they were created.

10. Privacy and Data Processing

The Service Provider processes personal data in accordance with the General Data Protection Regulation (GDPR). Uploaded invoices are deleted immediately after data extraction. Only the data necessary for generating the WIK letter is stored.

11. Availability and Maintenance

The Service Provider strives for the highest possible availability of the Platform but does not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond the Service Provider's control. The Service Provider is not liable for damage resulting from temporary unavailability.

12. Termination

The User may terminate their account at any time via the account settings or by contacting the Service Provider. Outstanding credits expire upon termination and will not be refunded.

The Service Provider may terminate the User's account in the event of a breach of these terms, (suspected) fraud, or when continuation of the service can no longer reasonably be expected.

13. Governing Law and Disputes

These Terms and Conditions and all agreements between the Service Provider and the User are governed by Dutch law.

Disputes shall be submitted exclusively to the competent court in the district of Amsterdam.
